1321 (07/2026) Chapter 9: Summer EBT Program (SEBT) Hearings Once an application is processed and an eligibility decision has been made, the filing group has the right to request a hearing. Before starting the hearing process, the filing group can ask for their case to be reviewed. This allows them the opportunity to discuss their situation, share information, and understand the reasons behind the decision. If the issue cannot be resolved during the case review, the filing group can request a hearing. The request can be made either verbally or in writing. The filing group can complete the Administrative Hearing Request form (MSC 443) and send it to the Department, or they can ask a Department representative for assistance in completing the form. The filing group does not need to sign the request; a verbal request to the Department representative is sufficient. The filing group can withdraw their request for a hearing at any time. SEBT hearing requests are not eligible for an expedited hearing or continuation of benefits. Oregon Administrative Rule(s) 461-196-0130 – Hearing; SEBT 461-025-0310 – Hearing Request Quality Control review Verification Sample of three percent of Approved Applications The Department must verify eligibility of children in a sample of SEBT applications approved for benefits for the summer. • The sample size for the Department must equal three percent of all SEBT applications approved by the Department from the start of the eligibility period through June 1 of the school year immediately preceding the summer operational period, selected randomly from all applications. • Individuals must provide verification when requested by the Department. The Department will notify the filing group through a Notice of Request for Information when verification, or additional verification, of any factor affecting eligibility is required. • If the filing group refuses to cooperate or does not provide verification when requested by the Department, the filing group’s eligibility for SEBT benefits will be denied. Opting-Out A filing group can choose to decline or opt out of SEBT benefits. They can inform the Department that they do not want the benefits or if the benefits have been issued, they can request to have the benefits removed. Once the Department receives this notification, it will be recorded in their SEBT case. When the request to remove the SEBT benefits comes from the filing group, the 30-day notice required for removing benefits is not required. If the filing group would like to be considered for SEBT benefits in the future, they will need to contact the Department or apply for SEBT benefits in the future.
