1320 (07/2026) Chapter 9: Summer EBT Program (SEBT) Once benefits are expunged, they cannot be reissued. Program Integrity Intentional Program Violations (IPV) In the SEBT program, an intentional program violation (IPV) occurs when a person aged 18 or older knowingly provides false information, misrepresents facts, or hides important details related to their request for SEBT benefits. If someone is disqualified for an IPV, they cannot receive SEBT benefits for qualifying children during their disqualification period. An authorized representative may represent or assist a SEBT applicant or participant as needed, including a child whose parent or legal guardian is subject to an IPV in the SEBT program. An IPV is confirmed through a final order after an IPV hearing or by the Department after receiving a signed form (MSC 649C) acknowledging the violation. Penalties for intentional program violation apply to individuals aged 18 and older who either: • Committed an IPV, or • Allegedly encouraged someone under 18 to commit an IPV. If an IPV is established against a person in the filing group that applied for SEBT benefits for qualifying children, they will face disqualification for a specific period: • First IPV: 12 months • Second IPV: 24 months • Third IPV: Permanent After completing their disqualification period, the individual can apply for SEBT benefits for qualifying children in the next summer operational period. If an overpayment is caused by a mistake of the agency or client error, the agency will not take action to recover those funds. Additionally, the Department will not recover the overpayment monies from SNAP or any other public assistance program. Oregon Administrative Rule(s) 461-196-0160 – Overpayments; SEBT
