1322 (07/2026) Chapter 9: Summer EBT Program (SEBT) Replacement of SEBT benefits SEBT benefits may be replaced if food purchased with SEBT benefits has been spoiled or destroyed due to a disaster or filing group misfortune, such as a fire, flood, or loss of electricity. However, it’s important to note that a power shutoff by the utility company due to non-payment does not qualify as a disaster or filing group misfortune under this policy. Once it is confirmed that the food was spoiled or destroyed as a result of a valid disaster or filing group misfortune, please follow the guidance for SNAP under the Manual Issuance Benefit Replacement EG. If a filing group experiences a misfortune or disaster, the Department will replace the value of food purchased with SEBT benefits if the following conditions are met: • The food was destroyed due to the misfortune or disaster. • The misfortune or disaster is verified. • The filing group reports the loss of food. • The filing group submits: • The total cost of food lost or destroyed. • A signed statement or affidavit (DHS 349d) attesting to the loss. The replacement process is as follows: • The amount replaced will be the value of SEBT benefits spent prior to the date of disaster or misfortune, up to the full benefit amount per child for the summer operational period. • The Department will issue a replacement within ten days of the filing group reporting the loss or within two working days of receiving a signed statement or affidavit and verification of the misfortune or disaster. The Department will replace stolen or compromised SEBT program benefits only if the loss is due to one of the following reasons: • The Department issued the EBT card to an unauthorized individual who was not in the filing group. • The Department failed to cancel the EBT card after the filing group reported it lost, stolen, or compromised. For replacement, the filing group must report the loss to the Department. An EBT card reported lost, stolen, or not received will be replaced only after the current card has been deactivated. A damaged or malfunctioning EBT card will be replaced only after its status is changed to “card damaged” and the card is destroyed. The Department will not replace SEBT benefits stolen due to electronic benefit theft, which includes: • Card Skimming: Theft of EBT card information using a store’s card-swiping machine. • Card Cloning: creating a fake EBT card for using information obtained from card skimming. • Other Fraudulent Methods: Compromised EBT card information through electronic means, such as scams via text, email, or phone. This does not include the theft or unauthorized use of a physical EBT card. Oregon Administrative Rule(s) 461-196-0140 — Replacement of Benefits; SEBT
