1305 Chapter 8: Examples • Examples (07/2026) and is in her 3rd month of pregnancy. She has done a home pregnancy test and knows the date she conceived. Lisa meets all other TA-DVS eligibility. The worked applies the ‘Late term pregnancy is waived’ eligibility waiver and approves TA-DVS. The worker explains to Lisa that in order to access payments, she will need to provide verification of her pregnancy from a medical professional with her estimated due date. Example 3: Tonya is in the office applying for TA-DVS for herself and her two children, as she recently fled her abuser. She reports during intake she is currently on strike at her job due to bargaining, and she is unsure of how long she will be on strike. The worker determines that Tonya meets all other TA-DVS eligibility and applies the ‘Individual on strike restriction is waived’ eligibility waiver, and approves TA-DVS.
What requirements cannot be waived Example 1: Scott is in the office applying for TA-DVS. During the intake, he states that his only child was removed from his home by Child Welfare due to the domestic violence situation. Scott states that he is working with Child Welfare and believes his son will be returned to his care once he stabilizes his living situation and obtains safe housing. The worker calls Scott’s Child Welfare worker and is able to confirm that the reason the child is out of the home is due to the domestic violence situation, and that once Scott is stabilized his son will be returned to his care. The worker approves TA-DVS eligibility and will need to reaffirm with the CW worker that the son will be coming into the survivor’s care before approving payments. Example 2: John is in the office today applying for TA-DVS. His girlfriend of two months, Katrina, is the abuser. John states that there has been a history of verbal and physical abuse, and he has fled with Katrina’s 16-year-old daughter, Kylee. He is applying for TA-DVS for himself and Kylee. The worker determines that there is no caretaker relative relationship between John and Kylee, and John has no other children. TA-DVS is denied, the worker provides information for community resources and connects John with a co-located DV advocate. Example 3: Ameer and her two children are in the office applying for TA-DVS. They came to Oregon last week on vacation to visit family from Texas. While they were here, Ameer disclosed to family that she is in an abusive relationship with her husband and wants to find a way to get her own place in Texas for her and the children. Because Ameer does not live in Oregon and was not fleeing to/through Oregon, Ameer does not meet Oregon residency requirements and TA-DVS is denied. The worker helps safety plan with Ameer, provides national resources, and information to co-located advocates locally for help with connection to other state resources as well as additional safety planning. Chapter 5, section 8: Payments Payment limit Example 1: Alexis was approved for TA-DVS. Her safety plan was to get housing and she is waiting for her housing voucher. Alexis got her housing voucher and her requested home passed inspection on day 88 of her certification period. Alexis got her rental agreement and brought to ODHS as soon as possible at 4:00 on day 90 of her certification period. Her worker was not able to get the payment authorized before the end of the day. ODHS can make payment on day 91, because all information was received, and ODHS was unable to issue payment.
