Volume 2 - Supplemental Nutrition Assistance Program (SNAP) MS 2930 – R. 6/30/26 – OMTL – 684 Ineligible Alien – Deductions
A. [Apply the earned income deduction to the pro rata share of the ineligible alien's countable earned income.
B. Divide the household's allowable shelter and dependent care expenses equally among the members, including the ineligible alien and any other excluded members. Count all but the prorated share of the excluded member as a deductible expense to the remaining household members.
C. Do not include the ineligible alien as a member of the household when determining the household size for the following:
1. Assigning a benefit level; 2. Comparing the household's gross monthly income with the income eligibility standards; or 3. Comparing the household's resources with the resource eligibility limit.
Additionally, the household is not entitled to a medical deduction if the only elderly or disabled individual is an ineligible alien.
Example: A household of four, including the ineligible alien, incurs $100 in shelter expenses per month. Divide the amount by the number of household members to determine each member’s pro rata amount: $100 ÷ 4 = $25. Subtract the ineligible alien’s pro rata amount from the total to determine the countable deduction: $100 – $25 = $75 allowable deduction. When determining the benefit level, gross monthly income limit, and resource eligibility limit, this household is a size of three.]
