ESA SNAP Policy Manual 164 Destitute migrant and seasonal farmworker households: Migrant and seasonal farmworkers who are considered destitute will have their gross and net income, as calculated in Section 13.5.1.1, Destitute Migrant and Seasonal Farmworker Households, compared with the gross and net income limits. All other households: All other households will have their gross and net monthly income, as calculated in Section 13.5.1, Net Monthly Income, compared with the gross and net income limits. Legal Authority Income eligibility (federal): SNAP: 7 CFR § 273.10(e)(2)
13.5.3 Benefit Levels SNAP households that meet income and nonfinancial eligibility must have their monthly SNAP benefit levels calculated as follows: 30 percent of net income: Multiply net monthly income (as calculated in Section 13.5.1, Net Monthly Income) by 30 percent, rounded up if the result ends in cents. Maximum SNAP allotment: Determine the maximum monthly SNAP allotment for the household’s size in effect at the time of eligibility determination (see Table 25.3.a, SNAP Monthly Income Eligibility Standards). Monthly benefit level: Subtract from the maximum SNAP allotment for the household’s size 30 percent of net income to determine the household’s monthly SNAP benefit amount. − Except for the initial month of benefits, one- or two-person households must not have a monthly benefit level less than the minimum monthly benefit amount (see Section 13.5.3.3, Minimum Monthly Benefit Amount). 13.5.3.1 Determining Initial Month of Benefits A household’s benefit level for the initial month of certification will be based on the day of the month the household applies for benefits (see exceptions below). The household will receive prorated benefits from the date of application to the end of the month. Prorate over the exact length of the month during which the application was filed using the SNAP Allotment Proration Table provided by FNS annually. Round the prorated amount down to the nearest lower whole dollar. Formula for Prorating Initial Month Benefits (number of days in the month + 1 – application date) x full monthly benefit ______________________________________________________________ number of days in the month
