ESA SNAP Policy Manual 163 13.5.1.1 Destitute Migrant and Seasonal Farmworker Households The gross and net monthly income for migrant and seasonal farmworkers who are destitute (see Table 25.1.a, Glossary of Terms) is calculated differently from other households. Only income received between the first of the month and the date of application is considered. Income the household anticipates receiving from a new source after the date of application is disregarded. The above only applies to the first month of each certification period at initial certification and recertification. 13.5.1.2 Households With Elementary or Secondary School Students Under Age 18 If a household contains a member younger than 18 who is an elementary or secondary school student and has earned income, ESA must consider the following when calculating gross and net monthly income to determine income eligibility and benefit levels: The earned income of the student will be excluded if the student turns 18 during the month of application but will be counted in the following months. If the student turns 18 during the certification period, the student’s income will be excluded until the month following the month in which the student turns 18. See Section 11.6, Excluded Income, for additional details. Legal Authority Net month income (federal): SNAP: 7 USC § 2014, 7 CFR § 273.10(e)(1) Destitute households (federal): SNAP: 7 CFR §§ 273.10(e)(2)(i)(C), (e)(3) Student income (federal): SNAP: 7 CFR § 273.10(e)(2)(i)(E), 7 CFR § 273.9(c)(7)
13.5.2 Income Eligibility Once gross and net monthly income is calculated in accordance with Section 13.5.1, Net Monthly Income, the household’s gross and net monthly income will be compared with the monthly gross and net income limits for the household size in effect at the time of eligibility determination (see Table 25.3.a, SNAP Monthly Income Eligibility Standards) as follows: Categorically eligible households: No gross and net income limits apply because these households were conferred SNAP income eligibility through another program or service (see Chapter 4, Categorically Eligible Households). Households with an older member or a member with a disability: Non-categorically eligible households with a member aged 60 or older (including a member who turns 60 in the month of application) or a member with a disability that are not destitute will only have their net monthly income, as calculated in Section 13.5.1, Net Monthly Income, compared with the net income limit.
