Exempt activities
The prohibitions of subparagraphs (B) and (C) of paragraph (1) shall not apply to the following business activities of any savings and loan holding company or any subsidiary (of such company) which is not a savings association:
(A) Furnishing or performing management services for a savings association subsidiary of such company.
(B) Conducting an insurance agency or escrow business.
(C) Holding, managing, or liquidating assets owned or acquired from a savings association subsidiary of such company.
(D) Holding or managing properties used or occupied by a savings association subsidiary of such company.
(E) Acting as trustee under deed of trust.
(F) Any other activity— (i) which the Board, by regulation, has determined to be permissible for bank holding companies under section 4(c) of the Bank Holding Company Act of 1956 [ 12 U.S.C. 1843(c) ], unless the Board, by regulation, prohibits or limits any such activity for savings and loan holding companies; or (ii) in which multiple savings and loan holding companies were authorized (by regulation) to directly engage on March 5, 1987 .
(G) In the case of a savings and loan holding company, purchasing, holding, or disposing of stock acquired in connection with a qualified stock issuance if the purchase of such stock by such savings and loan holding company is approved by the Board pursuant to subsection (q)(1)(D).
(H) Any activity that is permissible for a financial holding company (as such term is defined under section 2(p) of the Bank Holding Company Act of 1956 ( 12 U.S.C. 1841(p) ) 1 1 So in original. Probably should be followed by another closing parenthesis. to conduct under section 4(k) of the Bank Holding Company Act of 1956 [ 12 U.S.C. 1843(k) ] if— (i) the savings and loan holding company meets all of the criteria to qualify as a financial holding company, and complies with all of the requirements applicable to a financial holding company, under sections 4( l ) and 4(m) of the Bank Holding Company Act 2 2 So in original. [ 12 U.S.C. 1843 ( l ), (m)] and section 2903(c) of this title as if the savings and loan holding company was a bank holding company; and (ii) the savings and loan holding company conducts the activity in accordance with the same terms, conditions, and requirements that apply to the conduct of such activity by a bank holding company under the Bank Holding Company Act of 1956 [ 12 U.S.C. 1841 et seq.] and the Board’s regulations and interpretations under such Act.
