The community spouse monthly income allowance equals the greater of the following: 1.

The minimum monthly maintenance needs allowance determined under par. (c) or the amount determined at a fair hearing under sub. (8) (c), if such an amount has been determined, minus the amount of monthly income otherwise available to the community spouse.
(2)#
The amount of monthly support which a court orders the institutionalized spouse to pay for the support of the community spouse.
