1600.2.77 Representative Payment
A payment received by one person, the representative payee, for the needs of another person, the beneficiary. When the representative payee and the beneficiary are in the same 3SVT household, count the payment as unearned income to the household.
When the representative payee and the beneficiary are not in the same 3SVT household, treat the representative payment as follows: Count as unearned income to the beneficiary any part of the payment that the payee gives to, or uses for the needs of the beneficiary. Count as unearned income to the payee any amount that is not given to or used for the needs of the beneficiary.
When a representative payment is made to a payee that is intended for more than one beneficiary, and the beneficiaries are both 3SVT household members and non-members exclude only the identifiable portion of the payment intended and used for the care and maintenance of the non-member.
If a non-member’s portion cannot be readily identified, divide the payment evenly among all beneficiaries. Exclude the non-member’s prorata share or the amount actually used for the non-member, whichever is less.
