1600.2.76 Repayment Due to Intentional Program Violation (IPV)
Count money as unearned income when it is withheld from federal, state, or local means-tested programs to recoup an overpayment caused by the household’s intentional failure to comply with program requirements.
If the amount withheld is not due to intentional program violation, exclude it as a regular recoupment. See Recoupment .
Federal, state or local means-tested programs include Reach Up, General Assistance, State Supplementary Assistance, SSI, and veteran pensions.
Note : To determine if recoupment from SSI is an IPV, ask if it is due to being criminally charged with an IPV. If it is, then it is considered an IPV. Verify IPV status for SSI only when the household states it was due to IPV.
