5.9 Complaints in the Child Care Setting
A. Child Abuse or Neglect
All complaints regarding possible child abuse or neglect occurring in a child care setting must be referred to the Child Protective Services (CPS) unit at the LDSS serving the area where the provider is located. Information regarding the complaint must be shared with the agency responsible for licensure or approval. In situations when parents select a provider for whom there are child protective services concerns, LDSS must weigh the provider’s right to confidentiality with the parent's right to be informed and the child protected. If parents have been informed and continue to place their child in an unsafe environment, a referral to CPS may be in order.
B. Other Complaints
All other complaints should be referred to the Office of Child Care Health and Safety. Complaints may be made online at https://www.childcare.virginia.gov/families/file-a-complaint or by calling 833-778-0204.
