205 The disqualification contained in this section will not apply to a conviction if the conviction is for conduct occurring on or before February 7, 2014. If on an application or recertification or during an interview, a written or verbal response to the question, “Have you or anyone in your household been convicted after February 7, 2014 of aggravated sexual abuse, murder, exploitation of a child, sexual assault as defined in the Violence Against Women Act of 1994, or a similar state law and is also not in compliance with the terms of the sentence(s)?” is “yes”, the household member will be disqualified.
The worker should document all verbal responses to the question. Documentation of the response to the question should be completed in the folder notes associated with the case action in SCOSA.
If a SNAP household member is disqualified due to a conviction listed above in this section, that household member should be coded “DI CF” on CHIP SEPA screen. The household member will remain disqualified until verification of compliance with his/her sentence is received.
