Injuries on the Job If an employee/trainee becomes injured during the OJT placement period, all federal and state health and safety standards will apply. Job Retention The employer is expected to retain the employee/trainee, unsubsidized, at the agreed-upon wages after the successful completion of the OJT placement period. Limitations The OJT assignment may not result in: (a) the displacement of employees already working for the employer; (b) be used to fill a position for which any other employee is on layoff from the same or any equivalent positions; or (c) where the employer has terminated the employment of any regular employee or otherwise reduced its workforce for the purpose or effect of filling the vacancy with an OJT trainee. The term “displacement” includes alteration of an employed worker’s job resulting in the reduction of skill, content, salary, or promotional opportunity. Similarly, OJT will not be approved in the following situations when: 1. Work/training being performed is related to political, electoral or partisan activities. 2. Work/training being performed involves a commission as the primary source of income, such as real estate sales. 3. Funding for training is available and received from other sources for that employee/trainee. 4. In conflict with a collective bargaining agreement that applies to the specific OJT position or occupation held by the OJT employee/trainee. 5. The OJT employee/trainee will construct, operate, or maintain a facility used for sectarian instruction or as a place of religious worship. 6. The employer’s hiring process procedures will not discriminate against any individual based on race, color, religion, sex, national origin, age, disability, political affiliation or belief. 7. The working conditions will be unsanitary, hazardous or dangerous per Occupational Safety and Health Administration (OSHA) laws. 8. The employer is in violation of federal, state or local labor laws. 9. The employer is involved in a strike, lockout, or other unusual labor condition. 10. The employer is a member of or employs a member of the employee/trainee’s immediate family.
