700 Chapter 3:Processes and procedures • Section 4: Individual loss and restoration of benefits (07/2026) Example: Margie left the household and moved into a family member’s home in June due to a domestic violence situation and was not able to take any food. Margie’s alleged abuser spent the remaining June SNAP benefits that were on the EBT account, leaving Margie with no way to purchase food. Margie submitted a replacement request for the SNAP benefits the alleged abuser spent during the month of June. This request would need to be denied in ONE because this is not considered a household misfortune or electronic fraud. Example: Casey left an abusive situation and moved into a domestic violence shelter. The other household member spent the remaining SNAP benefits on the EBT card in the month Casey moved out. Because Casey moved into a domestic violence shelter, Casey can request SNAP benefits and receive a prorated SNAP allotment even though Casey was in two separate filing groups in the same month. This is considered a new request for SNAP benefits on a new case, allowable because Casey moved into a domestic violence shelter. Replacement of SNAP benefits lost due to electronic theft that occurred on or prior to 12/20/24, reported by 9/30/25. EBT card electronic theft can include card skimming and cloning, scamming through fraudulent phone calls or text messaging, and phishing. This policy does not include situations where the EBT card was lost or stolen by a person with access to PIN number. An individual may report EBT card electronic theft via mail, phone, email, or in person on or before 9/30/25. The household must attest to the following information: • if they had the card in their possession during the time of fraudulent transactions, • date of fraudulent transactions that occurred on or prior to 12/20/24, • total amount lost, • retailer and retailer address, and • any other details that can explain each report of benefit theft. The report must be made within 30 days of the date the household discovered the loss. Reports of loss of SNAP due to electronic fraud will no longer be eligible for replacement if reported on or after 10/1/25. The household must sign an affidavit of lost benefits, attesting to the date the loss was discovered, and the amount of the replacement benefits being requested. ODHS can replace electronically stolen benefits for the loss claimed or two months of the SNAP allotments received at the time of the theft, whichever is less. The signed affidavit must be received within 10 days of the reported loss. ODHS will process replacement requests within 10 days from the date the loss is reported, or within 2 working days after receiving a household’s signed statement of loss, whichever date is later. Claims should be validated through data provided on the EBT financial history screens in DHR. Example: Raven has SNAP benefits, and notices that $100 is missing from the EBT card. ODHS reviews Raven’s claim of theft and DHR records validate the household’s benefits were used for an on-line purchase that Raven did not make and the EBT card was in Raven’s possession. This is not questionable and ODHS is able to replace the $100 of EBT benefits that were lost due to theft.
