The effective date for a reduction or termination of an ongoing special need is the end of the timely continuing benefit notice period. Oregon Administrative Rule(s) 461-180-0040 — Effective Dates; Special Needs and Services 461-115-0030 — Date of Request Routing Special Needs Payments to Third Parties on Behalf of an Individual Special Needs Payments are client benefits and should be issued directly to the individual whenever possible. The person is responsible for making a payment for their approved need. An exception may be made to route a Special Need Payment to a third party on behalf of an individual if they are unable to manage their own finances, or when an Authorized Representative exists. An Alternate Payee designation must be obtained on the MSC 231 when routing a Special Need Payment to a third party on behalf of the individual, except in the following scenarios: • When routing a payment to the provider that is owed. For example, when routing a Room and Board payment to the facility, or a Moving Cost payment to the moving company. • When routing a payment to a parent or guardian on behalf of a minor child. • When using a two-party check method that requires the individual to endorse the check. Important Notes: • An Authorized Representative may designate themselves as Alternate Payee on the MSC 231 by signing on behalf of the individual and themselves. If the individual is determined to be incapacitated and there is no one with legal authority to designate an Alternate Payee, the Department may designate an emergency Alternate Payee under OAR 461-165-0035(4). • When an Alternate Payee designation is obtained for a Special Needs Payment, mark the “OSIP” box on the MSC 231. • In the ONE system, select “Authorized Payee” from the drop down. This is a ONE specific role that was created to capture an Alternate Payee designation for medical programs. Do not select “Alternate Payee” from the drop down as that applies to non-medical programs.
