512 (07/2026) Chapter 2:Eligibility • Section 9: Employed Persons with Disabilities (EPD) The participant fee must be paid monthly as a condition of eligibility. The fee may be waived due to significant economic difficulty resulting from unemployment, homelessness, divorce, domestic violence, illness, or other situations. The individual must provide verification of the economic difficulty for the worker to evaluate eligibility for the waiver. Do not pend for verification of the hardship. Client statement may be accepted if no other verification is available. No notice is required to approve or deny the waiver request. Add a case note to ONE explaining the situation causing the hardship, whether the request is approved or denied, and month(s) for which the waiver is applied if approved. There is no limit to the amount of time a hardship waiver may be applied, but it should be reasonable based on the individual’s situation. Inform the individual they will continue to receive the EPD Participant Fee billing notice each month. Refunding EPD participant fees paid in error EPD participant fees paid in error can be reimbursed retroactively up to 12 months. Locate the payment(s) that need to be refunded by either locating them on the APD Receipting Solution Intake Report or asking for assistance from leadership. Complete the APD Program Payment Refund Request and email the form to APD Client Receipting. Please note that APD Client Receipting is unable to provide guidance if there are difficulties locating the information required to complete the refund form, and they cannot advise which receipt should be refunded. They also do not pay a liability. The participant fee replaces the liability, but those in residential settings will still be required to pay room and board. When an individual is eligible for OSIPM with services under both the 300% of SSI standard (LTCSERV TOA in ONE) and EPD, ONE will approve EPD over LTCSERV. Rather than choosing one benefit over another based on the lowest cost to the participant (as was the process in the legacy systems), the system will instead set the EPD participant fee based on either the participant fee calculation or the patient liability calculation, whichever is lowest. For example, Mia is eligible for OSIPM with long-term care services through the 300% rule (LTCSERV) and EPD. The participant fee would be $100 and the calculated liability would be $50. ONE will approve Mia in EPD (Eligibility screen will show OSIPMEPD and NMAGISERV TOAs approved) with a participant fee of $50 (liability calculation resulted in the lower cost). EPD participant fees that are based on a liability calculation are still paid and receipted like any other participant fee. They will not be paid to the facility.
