007.03(A) CRITERIA FOR DETERMINING INTENTIONAL PROGRAM VIOLATION.

The Department of Health and Human Services hearing officer or Director will base the determination of intentional program violation on clear and convincing evidence which demonstrates that the household member knowingly, willfully and with deceitful intent committed an intentional program violation.
