FAP Negative Case Reviews Federal Policy - FNS 310 Handbook, Quality Control Review Handbook, Chapter 13 Negative Action Record Reviews, 1340 Application Processing Aspects of the Negative Review: Negative actions are reviewed to determine the validity of the agency’s action to deny, terminate, or suspend the FAP group. Certain failures to complete application processing requirements correctly are part of the review and may result in a negative action being determined to be inappropriate and, therefore, invalid. The application processing requirements include: 1. Failure to send an Appointment Letter when required or a Notice of Missed Interview (NOMI) when required, or sending the required letter or notices to an incorrect address; notification to the FAP group must be made accurately. 2. Failure to provide expedited service where appropriate. 3. Denial of action prior to the 30th day when verification was requested. 4. Denial of an application after the 30th day when not properly pended. 5. Failure to act on an application by the 30th day following the date of application. This results in withholding benefits to a household through inaction rather than an actual action. When the 30th day falls on a weekend or holiday, the action must be taken on the next business day following the weekend or holiday to be considered timely. Error Prevention Negative Action Case Review 1. All correspondence to the client regarding a negative action on a FAP case needs to be accurate. Any incorrect reason on the notice results in an error finding even if the household was not eligible for the program for another reason. 2. Confirm the address on the notice is accurate. Sending a notice to a wrong address will result in an error finding
