Division/Section Family Support Chapter No./Name 4 – Economic Stability (ES) Part No./Name B – Eligibility Factors Section No./Name B-1400-FITAP-SNAP-STEP SNAP Work Requirements Document No./Name B-1420-SNAP Exemptions from Work Registration Requirements Effective Date April 1, 2025
3 of 4 If an individual received UCB in the last 12 months and complied with the work requirements for UCB, that individual is exempt from work registration requirements. Work registration status ‘Unemployment Compensation’ should be used.
An individual who is enrolled at least half-time in a school (including high school) or training program that is not considered an institution of higher education is considered a student. The student is exempt from work registration requirements and must have a work registration status of ‘Student/Eligible’.
Verify that the person is needed to provide care for an incapacitated person. Verification from a medical provider must be obtained to verify the need for the incapacitated person. The Request for Verification of the Need for Full-Time Care (OFS 90L) may be used to verify if there is an incapacitated person who requires full-time care. Incapacity due to pregnancy complications must be verified. The worker's observation of an obvious disability is adequate justification for granting an exemption. If questionable, verify disability by a doctor's statement or other third party documentary evidence which supports the person's claim. The SNAP Disability Verification Form (SNAP 90) may be used.
Examples of questionable exemptions:
Example: A client reports she is disabled. She says her doctor does not want her to work. When asked what is her disability or what is the reason the doctor does not want her to work she says she is not really sure. She just knows he told her he does not want her to work. This is questionable. Verification would be needed to exempt the client.
Example: A client reports she is disabled. She says she is not able to work because of migraine headaches that she has been having for the last three years. The client stated she has never applied for disability because of her condition. Verification would be needed to exempt the client.
Example: A client reports at application that she is unable to work because she recently broke her right leg. Client is exempt due to temporary disability. At redetermination, the client reports she is unable to work because she recently broke her right leg. When questioned about previous report of breaking right leg she changes to say that it is now her left leg that is broken. The information is now questionable. Verification would be needed to exempt the client at redetermination.
