Volume 2 - Supplemental Nutrition Assistance Program(SNAP) MS 3850 – R. 1/1/22 – OMTL – 589 Authorized Representative (AR) Liability for Over-issuances
When another household member or the AR is actually interviewed, the head of household or the spouse reviews the application whenever possible. Emphasize that the household, as well as the AR, is held liable for any over-issuance which results from erroneous information given by the AR except in the following situations:
A. The Drug Addiction and Alcohol (DAA) treatment center, when acting on behalf of the resident, is held liable for all over-issuances.
B. The Group Living Arrangement (GLA), when acting on behalf of the resident, is held liable for all over-issuances.
1. In instances where the AR provides erroneous information, the AR is disqualified from serving as an AR. The household and the AR are responsible for the over-issuance. See MS 3860 regarding procedures for disqualifying an AR.
2. Establish an Inadvertent Household Error (IHE) claim against the household as a result of the erroneous information unless an administrative disqualification hearing determines a household member collaborated with an AR to commit an Intentional Program Violation (IPV).
3. If the hearing finds the household member collaborated with the AR to commit an IPV, establish the IPV claim against the household and disqualify the household member.
C. If a SNAP IPV disqualification is applied to an individual who is the head of household, the Integrated Eligibility Enrollment System (IEES) now requires the household to identify any AR to assist the household in making applications, recertifications, and using their Electronic Benefit Transfer (EBT) card.
1. If the individual who is selected to be the AR also has an IPV disqualification, a different AR must be appointed.
2. If the individual states that there is no one else available to represent them, there is an option for a short-term good cause to be listed. The good cause can only be used temporarily and must be addressed at the next application or recertification.
