Volume 1 – General Administration MS 1005 – R. 8/1/26 – OMTL-703 No Claim Determination
A. [A claim cannot be established when it is unclear if the individual completed an application or if an interview was conducted and there is no associated signed application.
The exceptions are:
1. Applications initiated by the individual on the Self-Service Portal (SSP); or
2. Instances of electronic benefit transfer (EBT) card trafficking or misuse. An individual who is alleged to have trafficked or misused benefits must have had their own historical Supplemental Nutrition Assistance Program (SNAP) and been informed of the program rules to be held accountable.
Example: An interview is completed by the Regional Claims Worker (RCW) and the individual states they had not been contacted or been in the office to complete an interview. The RCW’s investigation additionally finds no signed application on file. Since there is no clear evidence that the individual made an application, there would be no claim. However, the SNAP case should be discontinued.
Example: An individual applied for SNAP using SSP. The agency approved the application without conducting an interview. Since an application was initiated on the SSP, a claim can be pursued.
Example: An individual purchased SNAP benefits from a household with active benefits. The individual who purchased SNAP benefits has never had a SNAP case of their own and never been informed of the program rules. Since there is no clear evidence the individual who purchased SNAP benefits was aware of the program rules, a claim cannot be pursued.
Example: An individual sold their SNAP benefits to someone outside of their SNAP household. During the recertification, the agency failed to capture a signature on the KIF-101, Application for SNAP Benefits. Since the household has a historical record of completed signed applications, the agency can validate that the individual was made aware of the program rules and a claim can be pursued.]
B. If the claim referral has been completed and a determination of “No Claim” is made, document the case comments regarding the basis of the determination.
C. MS 1010, Procedures for Specific Households, should be referenced regarding procedures associated to lost or unsigned applications and electronic signature applications.
