Sec. 12. (a) Board members of the local ombudsman entity who are not free from conflicts of interest shall not participate in any discussion or vote on any matters pertaining to the program, and such recusal shall be made a part of the minutes or other official record of the local entity's board of directors or other comparable governing body. Such conflicts of interest include the following: (1) Current direct involvement in the licensing or certification of a long term care facility or a provider of a long term care service. (2) Current employment in, contractual arrangement with, or participation in the management of a long term care facility. (3) A current financial interest in a long term care facility or a long term care service. (4) Current membership in a trade association of long term care facilities.
