ESA SNAP Policy Manual 213 DCAS generates a standard notice that may require additional text to be added to meet adequate notice standards. Legal Authority Notice of Adverse Action (District): All: DC Official Code § 4–205.55(a)(2) Notice of Adverse Action (federal): SNAP: 7 CFR §§ 273.13(a)(2), 273.11(c)(4)(ii), 273.7(b)(2)(i) and (f)(1)(ii)
16.6.1 Timely Notice of Adverse Action Except as noted under Section 16.6.2, Exceptions to Timely Notice Requirement, adverse action notifications must be adequate (see Section 16.6, Notice of Adverse Action) and timely. A notice meets the timeliness standard if it is postmarked 15 days before the effective date of action. If the household’s benefit level decreases or the household becomes ineligible as a result of a change the household reported, ESA must issue the appropriate Notice of Adverse Action within 10 days of the date the change was reported. If there are 15 days between the date the notice is postmarked and the end of the month, the change must be made effective in the month following the month in which the notice was issued. If there are less than 15 days between the date the notice was mailed and the end of the month, the change must be made effective in the second month following the month the notice was sent. Example On September 20, Ms. Colton refused a bona fide job offer. Because Ms. Colton offered no good reason for refusing the job, ESA sent Ms. Colton a Notice of Adverse Action dated September 25. Because there were less than 15 days left in September from the date of the adverse action notification, full benefits continued to be paid to Ms. Colton in October, and she will serve her disqualification period beginning in November.
