Page 3 – Alabama WIC Vendor Agreement FY 2027-2029 certificate, approved by the Alabama WIC Program. e. Maintain at all times sufficient quantities of WIC approved foods as defined by the mandatory minimum stock requirements. The minimum stock requirements may be found at www.alabamapublichealth.gov/wic/vendors.html. Items must be within the manufacturer’s product eligibility dates to count towards the minimum stock requirement. No expired WIC food shall be available for sale. Vendor shall not use another store’s brand items as part of the minimum stock requirements. f. Provide WIC approved supplemental food items at prices that are competitive with other stores of similar size in Alabama. These prices shall not exceed the maximum price as set by the Department. g. Maintain authorization as a USDA Supplemental Nutrition Assistance Program (SNAP) retailer. h. Not currently be disqualified from a SNAP or WIC Program in any state and may not currently be paying a SNAP civil money penalty unless the civil money penalty is due to participant access. Disqualification or voluntary withdrawal from SNAP shall result in termination of the WIC Vendor agreement. i. Ensure owners, officers, or managers have not been convicted of, or had a civil judgment entered against them for, any activity indicating a lack of business integrity. Activities indicating a lack of business integrity include, but are not limited to, fraud, antitrust violations, embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, receiving stolen property, making false claims, or obstruction of justice. If during the term of this agreement any owner, officer, or manager of the Vendor is civilly or criminally charged, convicted, or has a judgement rendered against them, the WIC Vendor agreement will be terminated. j. Ensure that less than 50 percent of annual food sales revenue is derived from WIC transactions. k. Purchase formula solely from entities approved by the Department. The WIC approved formula list is maintained by the Department’s WIC Program and contains approved wholesalers and distributors licensed in Alabama and formula manufacturers registered with the Food and Drug Administration (FDA). The Department does not allow Vendors to purchase formula from other program Vendors. In the event of an investigation, only purchase invoices from those permitted suppliers will be considered as legitimate. Vendors must retain invoices, receipts, copies of purchase orders, and any other proofs of purchase for all WIC supplemental foods, including infant formula. The WIC Program may also require Vendors to provide written permission to confirm their infant formula purchase history with suppliers. This purchase documentation must be prepared entirely by the supplier or be on the supplier’s business letterhead. At a minimum, this documentation shall include: the name of the supplier; the date of purchase and the date the Vendor received the WIC supplemental food at the store, if different from the date of purchase; and a description of each WIC supplemental food item purchased, including brand name, unit size, type or form, and quantity. Failure to retain and provide this purchase documentation upon request may lead to disqualification from the WIC Program. l. Demonstrate its cash register system or payment device can accurately and securely obtain WIC food balances associated with an eWIC card, maintain the necessary files such as the APL and claim file, and successfully complete eWIC purchases. 4. Comply with eWIC Processing Responsibilities. The Vendor hereby agrees it shall: a. Execute and maintain a current service agreement with Alabama’s eWIC service provider if using a stand-beside point of sale (POS) device. Any stand-beside POS device provided by either the WIC program or Alabama’s eWIC service provider must be returned upon termination of a service agreement, or disqualification or termination of the Alabama WIC Vendor Agreement. b. Maintain an Alabama eWIC service provider certified in-store eWIC system in a manner necessary to ensure system availability for eWIC redemption processing during all hours the store is open. c. Not charge the Department any third-party commercial processing costs and fees incurred by the Vendor from EBT multi-function equipment. All commercial transaction processing costs and fees imposed by a third-party processor that the Vendor elects to use to connect to the eWIC system shall be borne by the Vendor. d. Comply with the current USDA eWIC Operating Rules, the Technical Implementation Guide (TIG) and all standards and technical requirements. e. Ensure the certified in-lane eWIC redemption process allows a reasonable degree of security for protecting the Personal Identification Number (PIN) used by the WIC participant. f. Request the Alabama eWIC service provider re-certify the Vendor’s in-store system if the Vendor alters/revises the system in any manner that impacts the eWIC redemption/claims process after initial certification is completed. g. Ensure all store personnel are fully trained on Alabama eWIC policies, procedures, and requirements, including training in the proper acceptance and processing of eWIC transactions. h. Vendor shall maintain documentation of WIC training for all staff involved with WIC, including the employee name and date of WIC training, within the confines of the Vendor’s store. i. Connect the Vendor’s in store system for each outlet covered by the Alabama WIC Vendor Agreement
