U.S. Notes (con.) (c) The quantitative limitations that may be established under any of subheadings 9903.18.01 through 9903.18.10 shall apply to sugar, syrups and molasses described therein during any effective period announced in the Federal Register by the United States Trade Representative for such a subheading in any year, during which period only the aggregate quantity of the specified goods shall be allowed entry into the customs territory of the United States. Such limitation shall apply notwithstanding any other quantitative limitation on such goods that may be provided for in the tariff schedule and the availability of any quantitative limitation set forth for such goods in chapter 17 or chapter 21 of the tariff schedule or allocation thereof. Any quantity set forth in a notice issued by the United States Trade Representative for any subheading specified herein may be allocated among supplying countries and areas and shall thereby supersede any quantity or allocation that may have been announced under additional U.S. note 5 to chapter 17. 16. (a) Except as provided in headings 9903.82.01, 9903.85.67, and 9903.85.68, headings 9903.82.02–9903.82.26 provide the ordinary customs duty treatment of certain articles of aluminum, of steel, or of copper and certain derivative aluminum or steel articles as provided for in subdivision (c) of this note. These headings are mutually exclusive, such that an imported article will be subject to no more than one of these headings. (b) For imported articles provided for in headings 9903.82.02–9903.82.26 that are eligible for special tariff treatment under any of the free trade agreements or preference programs listed in general note 3(c)(i) to the tariff schedule, the duties provided in these headings shall be collected in addition to any special rate of duty otherwise applicable under the appropriate tariff subheading. Goods for which entry is claimed under a provision of chapter 98 to the HTSUS and that are subject to the additional duties prescribed herein shall be eligible for and subject to the terms of such provision and applicable U.S. Customs and Border Protection (CBP) regulations, except that duties under subheading 9802.00.60 shall be assessed based upon the full value of the imported article. No claim for entry or for any duty exemption or reduction shall be allowed under a provision of chapter 99 to the HTSUS that may set forth a lower rate of duty or provide duty-free treatment, taking into account information supplied by CBP. All antidumping, countervailing or other duties and charges applicable to such goods shall continue to be imposed. (c) Headings 9903.82.02–9903.82.26 apply to the full customs value of articles classifiable in the provisions of the HTSUS enumerated in the following lists. For articles classified in the listed provisions that are not in chapters 72, 73, 74 or 76 of the HTSUS, headings 9903.82.02, 9903.82.04–9903.82.17 and 9903.82.20–9903.82.26 only apply where the weight of the applicable metal is at least 15 percent of the weight of the imported article. The applicable metal is identified in the title of each of the lists below. If an article is classified in a provision that is present on multiple lists, use the aggregate weight of the listed metals.
