31.1 Migrant Workers A “migrant worker” is a person who temporarily leaves their principal place of residence outside Wisconsin and comes to Wisconsin for not more than 10 months per year in order to accept seasonal employment in the planting, cultivating, raising, harvesting, handling, drying, packing, packaging, processing, freezing, grading, or storing of any agricultural or horticultural commodity in its unmanufactured state.
“Migrant worker” does not include any of the following: • A person who is only employed by a Wisconsin resident, and the employer or the employer’s spouse is the person’s child, parent, grandchild, grandparent, brother, sister, aunt, uncle, niece, or nephew. • A student who is enrolled (or has been enrolled during the past six months) in any school, college, or university, unless the student is a member of a household that contains a migrant worker.
Certain migrant workers and their families qualify for a simplified application procedure when applying for BadgerCare Plus or Medicaid in Wisconsin. For policies related to migrant workers, see BadgerCare Plus Handbook, Chapter 12 Migrant Workers.
