(b) Consider recommendations by the environmental justice 1 council; and 2 (c)(i) If the agency is not a covered agency subject to the 3 requirements of chapter 70A.02 RCW, create and adopt a community 4 engagement plan to describe how it will engage with overburdened 5 communities and vulnerable populations in allocating funds or 6 administering grants or programs from the climate investment account. 7 (ii) The plan must include methods for outreach and communication 8 with those who face barriers, language or otherwise, to 9 participation. 10 (4) During the 2023-2025 fiscal biennium: 11 (a) The requirement of subsection (1) of this section to conduct 12 an environmental justice assessment applies only to covered agencies 13 as defined in RCW 70A.02.010 and to significant agency actions as 14 defined in RCW 70A.02.010. 15 (b) Agencies shall coordinate with the department and the office 16 of financial management to achieve total statewide spending from the 17 accounts listed in subsection (1) of this section of not less than 35 18 percent and a goal of 40 percent of total investments that provide 19 direct and meaningful benefits to vulnerable populations within the 20 boundaries of overburdened communities as otherwise described in 21 subsection (1)(a) through (d) of this section and in accordance with 22 RCW 70A.65.230. 23 (c) The requirements of subsection (3)(c) of this section for 24 agencies other than covered agencies to create and adopt community 25 engagement plans apply only to executive branch agencies and 26 institutions of higher education, as defined in RCW 28B.10.016, 27 receiving total appropriations of more than $2,000,000 for the 28 2023-2025 fiscal biennium from the accounts listed in subsection (1) 29 of this section. 30 Sec. 937. RCW 70A.65.100 and 2022 c 181 s 3 are each amended to 31 read as follows: 32 (1) Except as provided in RCW 70A.65.110, 70A.65.120, and 33 70A.65.130, the department shall distribute allowances through 34 auctions as provided in this section and in rules adopted by the 35 department to implement these sections.
