Don't establish an intentional overpayment when the overpayment is directly due to any omission, neglect, or error by the department unless: The client kept the assistance; and Knew or had reason to believe they weren't eligible for the assistance.

Establish an intentional overpayment for funds that were authorized to replace lost, unendorsed warrants when it is later determined the claimed loss was false. See WAC 388-412-0035 .
