18.02 Assignment of rights to payments

In general. An individual who is applying for, or enrolled in Medicaid, with the legal authority to do so, must assign their rights to medical support and third-party payments for medical care. If they have the legal authority to do so, they must also assign the rights of any other individual who is applying for or enrolled in Medicaid to such support and payments. Exceptions. No assignment is required for: 18 8 USC § 1613(c)(2)(F). 19 8 USC §§ 1612(b)(2)(C) and 1613(b)(2). 20 42 CFR § 435.610. Nonfinancial eligibility requirements Part 3 – Page 11 (Sec.18.00, Sub.18.03) (1) Medicare payments; or (2) Cash payments from the Department of Veterans Affairs for aid and attendance.
