1400.8 Claims

SCE and ECE cannot be cancelled retroactively.

Households cannot be over the income or resource limits in any month they were SCE or ECE.

Do not establish a 3SVT claim when an overpayment is: due to excess resources for any household determined SCE or ECE, or because a household should not have been categorically eligible due to a mistake in granting eligibility for the program that made it SCE or ECE.

Claims can be made against SCE or ECE households if an overpayment occurred because: the benefit determination was not correct, or the household was not eligible for SCE or ECE as described in Ineligible Households above.
