M0110.110 Confidentiality

A. Confidentiality MA applicants and recipients are protected by federal and state confidentiality regulations, 42 CFR 431.300 and 12VAC30-20-90. These regulations were established to protect the rights of clients to confidentiality of their information. B. Release of Client Information Except as otherwise indicated, no person shall obtain, disclose or use, authorize, or permit the use of any client information that is directly or indirectly derived from the records, files or communications of the agency, except for purposes directly connected with the administration of the MA programs, which include but is not limited to: • establishing eligibility,

• determining the amount of medical assistance,

• providing services for recipients, and

• conducting or assisting in an investigation, prosecution or a civil or criminal proceeding related to the administration of the program.
