When A Protective Payee must be assigned
Staff at an Employment Center will assign a protective payee when they have made a determination that the customer either:
Has demonstrated an inability to manage funds. Non-payment of bills may be an indication that mismanagement of funds may exist. However, determination that mismanagement exists cannot be made solely on the fact that bills are often paid late, or
Is physically or mentally incapable of expending a money payment for the purposes for which it is intended.
In this situation if the need for a protective payee will continue, or is likely to continue, beyond 2 years judicial appointment of a guardian or other legal representative must be sought. When the appointment has been made, the guardian or legal representative will become the protective payee for this customer.
