Policy Effective: August 1, 2009
Married couples meet the impairment criteria and time limits on an individual basis. If the household includes an ineligible spouse, the income and assets of the ineligible spouse must be counted when determining the eligibility of the household. The household can consist of any combination of impaired, non-impaired, short-term disabled, or long term disabled as long as at least one spouse meets the eligibility requirements. The spouse that does not meet eligibility requirements is not included in the financial payment.
The individual must be at least eighteen years of age or emancipated.
A person who is not legally emancipated may claim to be factually emancipated. If the parents are available, the Department of Workforce Services (DWS) Employment Counselor shall contact them by telephone or use Form 544 , Affidavit of Non-Support, to determine if they will support the child.
If the parent will support the child, the child is ineligible.
If the parents refuse to support the child or are unavailable, complete duty of support procedures.
If the child refuses without good cause to cooperate in locating the parents, the child is ineligible.
See policy 240-2B for information to determine if an individual is legally emancipated or factually emancipated.
