Policy Effective: September 1, 2011

When a customer or authorized representative notifies the Division of Adjudication or the Administrative Law Judge (ALJ) that they want to cancel the hearing and not proceed with the appeal, a decision dismissing the appeal will be issued within 10 days of the date of written or oral request. This decision will have the effect of upholding the Department decision. The customer will have 10 days in which to reinstate the appeal by filing a written or oral request for reinstatement with the Division of Adjudication.
