Policy Effective: April 1, 2004
The customer can ask for postponements of the scheduled hearing. These postponements cannot exceed a total of 30 days. The Administrative Law Judge (ALJ) may adjourn, reschedule, continue or reopen a hearing on the ALJ’s own motion or on the motion of the customer or the Department.
A party that is unable to proceed with or participate in the hearing on the date or time scheduled must request that the hearing be rescheduled to another day or time.
The request for rescheduling must be made prior to the hearing.
The request must be made orally or in writing to the ALJ who is scheduled to hear the case.
The party who requests rescheduling must show a reasonable reason for the request.
More than one request to reschedule will not normally be granted.
The rescheduled hearing must be held within 30 days of the original hearing date.
