The Office of Recovery Services (ORS) has complete responsibility for determining if a customer is cooperating with Child Support Enforcement. If a customer disagrees with ORS’s determination of non-cooperation with Child Support Enforcement, they must ask ORS for a review of the non-cooperation determination.
If a parent has requested a Fair Hearing on the non-cooperation issue, the Department of Workforce Services (DWS) Administrative Law Judge (ALJ) cannot issue a decision that would change or modify ORS’s determination of non-cooperation. An ALJ may make a decision on whether DWS followed the required policy and procedures upon receiving notification from ORS of the customer’s non-cooperation.
