Effective Date: July 1, 2008
No Previous Policy
Employees of the Department of Health and Human Services and the Department of Workforce Services are prohibited from advising or encouraging applicants or recipients to terminate employment or otherwise reduce income for the purpose of qualifying for Medicaid or CHIP. This does not mean that employees cannot tell applicants or recipients about the Medicaid spenddown program and the ways to reduce or meet the medical excess with medical bills to be able to receive Medicaid coverage. Workers can explain eligibility policies, describe what income deductions an enrollee receives, and may respond honestly to direct questions about policies.(See Medicaid sections 400 and 415 for rules on using medical bills to meet a Medicaid spenddown.)
