If the person has an AR and was not legally deemed incompetent, either the person or the AR must make the required reports.

If the person’s co-payment is impacted by either the community spouse or a dependent family member, the person, AR, community spouse or dependent family member is responsible for making required reports to HHSC.

If the person has a legal guardian and was legally deemed incompetent, the legal guardian is responsible for making required reports to HHSC.
