908 Chapter 5:Temporary Assistance for Domestic Violence Survivors (TA-DVS) Program • Section 7: Waiving eligibility requirements (07/2026) • The requirement that a dependent child live with a caretaker relative, unless:
The child is out of the home due to safety reasons related to the domestic violence situation, or the caretaker is homeless because of the domestic violence situation, and
The child is expected to return within the 90-day certification period. Check with the Child Welfare worker to determine when the child will likely be returned to the survivor if • The only child is in Child Welfare custody due to domestic violence in the household, and • The parent does not have care, control and supervision of the child. At intake – Attempt to connect with Child Welfare to determine if it is likely that the child will be returned to the survivor’s care within the 90-day certification period. Child Welfare is not trained in TA-DVS eligibility. It’s important to ask questions in a way that gathers the information needed to determine eligibility. Keep in mind that the worker may not be able to verify or confirm that the children will be back in the survivor’s care during the timeframe provided as often it is dependent on the survivor stabilizing and becoming safe. If Child Welfare states it is likely the children will be returned within the 90-day certification period, consider the dependent child part of the household for initial eligibility. If Child Welfare is unable to say it is likely the child will be returned within the 90-day certification period, deny TA-DVS. Let the survivor know they can reapply when the child is returned or is close to being returned. Refer the survivor to other appropriate resources, including the local co-located domestic violence advocate. Click here for Co-located domestic violence advocates. There may be times that Child Welfare cannot be reached to confirm at intake. When this happens, take the survivor’s statement of when they anticipate the child to be returned to their care, and consider the dependent child part of the household for initial eligibility. At TA-DVS payment request –Confirm with Child Welfare that the child has returned or that the child will be returned upon payment. (e.g. Child Welfare intends to return the children once the survivor finds safe housing. We would approve payment for safe housing, based on Child Welfare confirmation that the children will be returned). Explain this to the survivor during the intake so they can safety plan and prepare for this when they request payment. Click here for examples: What requirements cannot be waived.
