The hearings process provides a “second look” to ensure the benefit or overpayment decisions are correct. Hearings are also held to resolve other issues (see hearings guide). Administrative Law judges from the Office of Administrative Hearings (OAH) preside over each hearing, and ODHS|OHA’s position in the hearing is explained by an ODHS|OHA representative, usually a Compliance Specialist (Hearing Rep). When an individual requests a hearing, they are then referred to as the “Claimant”. ODHS|OHA staff continue to work as appropriate with an individual who has requested a hearing. All hearing requests must be submitted to ODHS|OHA within 24 hours of the date the consumer requested a hearing. For more information, click here for Hearings guide.
