Oregon Administrative Rule(s) 461-155-0680 — Special Need – Supplemental Communication Allowance; OSIPM Personal incidentals and room and board allowances Personal incidentals and room and board allowances are allowed for the following individuals to avoid placement in a nursing facility or who are leaving a nursing facility or an acute care hospital to reside in a community-based care (CBC) facility. The payment amount is prorated in the first month for individuals who move to a CBC facility on any day other than the first day of the month. • An individual who is determined eligible based on a disability determination made by ODHS|OHA,
To receive this payment, an individual must pursue SSI by completing an application with the SSA and appealing denials until SSA makes a final administrative decision. If SSI is denied at the final administrative level, the individual is no longer eligible for this payment.
The payment is the difference between the individual’s countable income and the OSIPM adjusted income standard. • An individual who is leaving a nursing facility and limited to a maximum SSI payment of $30 or to a maximum veteran benefit payment of $90. The payment is the difference between the individual’s countable income and the OSIPM adjusted income standard.
To receive this payment, the individual must pursue reinstatement back to the full SSI standard with the Social Security Administration or the full rate of pension with the Veteran Affairs office. • An individual who is a qualified non-citizen who is not eligible for SSI due to not meeting the requirements to become a naturalized citizen within the SSI time limit.
The individual must pursue naturalization.
The payment is the difference between the individual’s countable income and the OSIPM adjusted income standard. Some non-citizens can receive SSI for a maximum of 7 years starting on the date they are granted a qualified immigration status. If the individual does not become a naturalized citizen their SSI will end after this 7-year period. This Special Need payment may be issued for these individuals if their SSI has ended after the 7 years, while they pursue naturalization, subject to the payment requirements in rule. This payment does not apply to individuals who never received SSI for a maximum of 7 years under a qualified immigration status. See SSA Spotlight on SSI Benefits for Non-Citizens for more information on qualified status. • An individual who does not have sufficient income to divert to the individual’s community spouse due to the difference between the personal needs allowance related to a nursing facility placement and the personal needs allowance and room and board related to a CBC facility placement. The allowance is issued only when the individual or community spouse requests or chooses a nursing facility placement rather than a CBC facility placement because the community spouse needs the resulting higher diversion amount to meet their monthly expenses.
