551 (07/2026) Chapter 2:Eligibility • Section 10: Long-Term Care (LTC) services Individuals with intellectual disabilities (ICF/IID). • Service plan/Receiving services: The individual must have an active service plan within 90 days of all qualifications being met. • Financial eligibility: The individual must be OSIPM eligible. The DD waiver and K Plan amendment are for home and community-base services (HCBS), like the Aged and Physically Disabled (APD) Long-Term Care Waiver. The Oregon Administrative Rules (OARs) used in determining financial eligibility for a service-eligible individual apply to all HCBS Waivers and the K-State Plan Amendment, whether under APD or DD. This includes the use of income cap trusts and income up to 300% of the SSI standard for OSIPM eligibility. Note: Individuals cannot receive services under more than one waiver concurrently. Adult I/DD services For adults with I/DD, ODHS|OHA manages the medical case while the ODDS case management entity (CDDP or brokerage) provides case management services. I/DD service eligibility for adults under 65 Individuals must have their I/DD determination established through the local CDDP office prior to any service authorization. A comprehensive review is completed using the individual’s medical records and test scores. If found to meet the disability eligibility requirements according to Oregon Administrative Rule (OAR), all services are then coordinated via the chosen case management entity (CME), except for nursing facility stays. Individuals under 65 may receive APD/AAA services while they are waiting to be evaluated or approved for I/DD services if they meet State Plan Personal Care or SPL and all other eligibility requirements. Once they are approved for I/DD services, however, APD/AAA services should close following a timely continuing benefit notice and coordinate with opening services at the CDDP or brokerage of the individual’s choice. I/DD service eligibility for adults over 65 Individuals with I/DD who are 65 and over may choose to be served within the APD/AAA or I/DD system, if they meet service eligibility for both. This assessment is most often facilitated via the I/DD service planning team process. Services cannot be provided to these individuals under both waivers at the same time. If a person is transitioning from one service system to another, the sending agency will send a timely continuing benefit notice and stop providing services with services opening through the receiving agency immediately following for a seamless transition. Adult residential or in-home care and State Plan Personal Care (SPPC) To establish service eligibility: • CDDP staff will complete I/DD disability determination prior to service eligibility. • If the individual is to be enrolled into an I/DD waivered or K plan service, CDDP staff will send enrollment information to the Technical Assistance Unit (TAU) for initial waiver service entry. • The TAU will enter the service category and create/update the Non-CAPS Service Eligibility record (SELG). • CDDP staff may need to:
