365 (07/2026) Chapter 2:Eligibility • Section 5: Financial eligibility (c) For HSD medical programs, exclude program benefits for monthly and annual income. OSIPM-IC payments made to care providers are excluded if the care provider is living in the same home as the individual they are providing care for. If the care provider’s income is coded on the case in ONE for another program, you must also code the same amount on the MAGI Deductions screen as an “other allowable deduction” so the income is considered accurately for the MAGI programs. (d) For OSIPM and MSP, OSIPM-IC payments made to care providers are countable earned income regardless of where they reside. Note: OSIPM-IC is the Independent Choices Program. Exclude all payments from TA-DVS for all programs regardless if paid to the participant or as a third-party payment. For HD medical programs, exclude program benefits for monthly and annual income. The exclusion: • Does not apply when home equity exceeds the limit in OAR 461-145-0220 (2)(a), and • Applies to all other resources (see Long-term care insurance worker guide for additional information). For the amount of resources excluded under this rule, ODHS|OHA will not establish a claim against the estate of the deceased individual in accordance with OAR 461-135-0835.
