The care provider may be employed by an in-home care agency or the person receiving care. The person receiving care must be enrolled in a Medicaid in-home service program including, but not limited to: • Agency with Choice • Children’s Extraordinary Needs (CEN) program • Consumer-Employer Program (CEP) • Independent Choices Program (ICP) • Oregon Project Independence – Medicaid (OPI-M) There are no questions in ONE or the paper applications (OHA 7210 and DHS 415F) that ask about Difficulty of Care payments. Eligibility workers can help make sure this income is counted correctly by asking the individual if: • They live with the person for whom they provide care, either in their home or the home of the person receiving care. • The person for whom they provide care receives Medicaid in-home services. • Their income is federally taxable. For all programs except MAGI, difficulty of care payments are countable earned income for the care provider. In order for ONE to properly exclude the income for MAGI, it also needs to be coded as a MAGI Deduction (under “Other Allowable Tax Deduction/Expense)”, and a case note should be added. The amount and frequency coded on the MAGI Deduction screen should be the same as what is coded as income. *See the Program Benefits section for more information on how ICP payments are treated for the ICP participant. Disability benefits This policy covers public and private disability benefits, except the following: • Agent Orange disability benefits • Radiation Exposure Compensation Act payments • Social Security based on disability or SSI • Veterans’ benefits
