192 (07/2026) Chapter 2:Eligibility • Section 4: Household information ERDC A child who lives with different caretakers during the month may be considered a member of both households. Shared custody includes ongoing living situations where the child lives part of the month with different parents or caretakers, or lives with a parent/caretaker and another approved caretaker–such as a resource parent–in the same month.
In shared caretaker situations, each eligible caretaker may have their own ERDC case, and the child can be included in both. If shared custody is not indicated in ONE and the child is already receiving ERDC on another case, the new case would be denied for that child. It is important to remind applicants to review and accurately complete this section when shared custody applies.
For standard ERDC, authorized child care hours are based on each caretaker’s highest verified work or school hours. Hours are not prorated based on how much time the child spends in each home. It is the responsibility of the parents/caretakers and the child care provider to ensure care is billed to the correct case.

HSD For HSD medical programs, it is important to determine where a child spends the majority of their time in a shared custody situation in order to ensure the correct individuals are included in their EDG.
For children whose parents are divorced, separated or unmarried, the custodial parent is the parent with whom the child lives, with the following considerations: • If the child lives part-time with both parents, the parent with whom the child spends most nights is the custodial parent. • If it cannot be determined which parent the child spends the most nights because the child spends equal nights with both parents, a court order or binding custody agreement establishing physical custody is used to identify the custodial parent. Please note, this is the only time ODHS|OHA should use a court order to determine who the custodial parent is for the HSD medical programs.
