Page 2 of 2 § 10:72-9.1 Purpose, scope and applicability Recipient was not responsible for any alleged Medicaid overpayment under N.J.A.C. 10:72-9.1(a). She credibly testified that she did not understand that the questions on the food stamp application relating to employment would include the errands she was assisting her neighbors with for which they were paying her nominal amounts. When she received the overpayment letter she immediately reached out to her social worker and he accompanied her to the Sussex County Board of Social Services (agency) to determine what was needed from her. The agency could have initially provided more specific instructions to the recipient and her social worker, who asked for those specifics, but they determined not to do so. In contrast, the recipient did everything that was asked of her. L.P. v. Sussex Cnty. Bd. of Social Serv., OAL DKT. No. HMA 03621-14, 2014 N.J. AGEN LEXIS 317, Initial Decision (June 6, 2014).
