Page 2 of 2 § 10:71-3.5 Resident defined the issue of whether treatment of otalgia warranted an "emergency" within the meaning of relevant regulations was to be determined on remand. R.F. v. DMAHS et al., OAL DKT. NO. HMA 12572-2016, 2017 N.J. AGEN LEXIS 469, Order Reversing and Remanding Initial Decision (January 11, 2017). Fact that a hospital patient who was a Colombian citizen in the U.S. on a tourist visa permitting him to remain in the U.S. for six months came to New Jersey for the purpose of receiving medical care negated residency, because the regulations defined a "resident" as "a person who is living in [N.J.] voluntarily and not for a temporary purpose," that is, with no intention of presently removing therefrom. Petitioner was not a "resident" of New Jersey as he was a temporary visitor to the U.S. As such, he was ineligible for any Medicaid benefits. J.G. v. DMAHS, OAL DKT. NO. HMA 5293-2016, 2016 N.J.
