In (a) and (d), substituted "45" for "30" and "90" for "60"; in the introductory paragraph of (c), and in (c)4 and (f), substituted "CWA" for "CBOSS"; in the introductory paragraph of (c), substituted "45/90" for "30/60"; in (c)1 and (c)2, deleted "or" from the end; and in (f), substituted "that" for "which" and "therefor" for "therefore". Annotations Notes Chapter Notes Case Notes Authorized representative of an applicant for Medicaid benefits failed to show that either the applicant's death, which occurred while the application was pending, or the death of her caseworker was the cause of the representative's failure to obtain and submit documentation requested in connection with the application. That was because much of the requested documentation that was still outstanding at the time of the denial of the application, from which this appeal was taken, was either requested while the applicant was still alive or was within the control of either the representative or the applicant's granddaughter. Thus, no exceptional circumstances existed justifying additional time to provide the requested documentation. E.W. v. DMAHS et al., OAL DKT. NO. HMA 03229-2021, 2021 N.J. AGEN LEXIS 421, Final Agency Determination (October 26, 2021). Where the applicant's Designated Authorized Representative (DAR) repeatedly failed to provide the requested documentation to determine eligibility, the Medicaid application was appropriately denied. The DAR and the applicant's spouse had 182 days from the first verification letter to the deadline set forth in the last verification letter to request, receive, and submit the information. The DAR's failure to timely request the documentation regarding the spouse's life insurance policy did not create a necessity for an extension of time. M.D. v. Div. of Med. Assistance and Health Servs., et al., OAL DKT. NO. HMA 11056-2020, 2021 N.J. AGEN LEXIS 234, Final Agency Determination (June 29, 2021). Social services board acted improperly when it refused to process a petitioner's Medicaid application on the ground that a certified translation of bank records that it had requested was not delivered by the September 5th deadline. Petitioner showed that she took reasonable steps to obtain the same and was able to obtain the translation by September 1. Because the next two days were legal holidays, petitioner should have been allotted the additional two days needed to mail the translation to the board. H.C. v. Hudson Cnty. Bd. of Soc. Servs., OAL DKT. NO. HMA 14152-18, 2019 N.J. AGEN LEXIS 111, Final Agency Determination (January 22, 2019).
