Page 8 of 14 § 10:71-2.2 Responsibilities in the application process responsibility to complete any forms required as part of the application process but had failed to do so. A.F. v. Middlesex Cnty. Bd. of Social Servs., OAL DKT. NO. HMA 09620-16, 2016 N.J. AGEN LEXIS 824, Initial Decision (October 3, 2016). Social services board acted properly in requesting income verification for a deceased nursing home resident for the two month period between August 1, 2015, the date of Medicaid eligibility requested by counsel, and the date of application, which was October 22, 2015, because the governing regulations made it clear that the month of application determined resource eligibility even if one was seeking eligibility from a date two months prior to the application. P.S. v. Camden Cnty. Bd. of Social Servs., OAL DKT. NO. HMA 05515-16, 2016 N.J. AGEN LEXIS 755, Initial Decision (September 9, 2016). County social services board adequately fulfilled its obligation to assist a nursing home employee who was making a Medicaid application on behalf of an aged resident by giving them over a year to obtain specified financial information. The resident had no family and limited ability to assist. Where, as here, the employee failed to provide income verifications despite best efforts and the granting of extensions, the board was justified in denying eligibility. R.S. v. Camden Cnty. Bd. of Social Servs., OAL DKT. NO. HMA 6126-16, 2016 N.J. AGEN LEXIS 696, Initial Decision (August 2, 2016). Social services board acted lawfully when it denied an application for Nursing Home/Institutional Medicaid on the ground that additional verification documentation was needed to establish eligibility and that partial documentation was not provided prior to the deadline. The applicant's son delivered the documentation to the wrong county agency because he did not want to stand in line at the Board's office, but the existence of a long line was not an exceptional circumstance excusing the son's failure to comply with the deadline. U.R. v. Camden Cnty. Bd. of Social Servs., OAL DKT. NO. HMA 04290-16, 2016 N.J. AGEN LEXIS 709, Initial Decision (July 29, 2016). Application for Medicaid benefits by nursing home resident should not have been denied on the ground, as claimed by the agency, that the resident had not cooperated with the agency's requests for additional information. The denial was issued only four days after the resident's representative advised the agency that requested information was forthcoming and the requested materials were provided on the day after the denial was issued. The agency's denial thus was unreasonable. A.H. v. Essex Cnty. Bd. of Social Servs., OAL DKT. NO. HMA 09245-16, 2016 N.J. AGEN LEXIS 647, Initial Decision (July 26, 2016). Medicaid applicant who was never notified of the need to provide documentation could not be denied benefits on the ground that he did not provide that documentation. L.B. v. DMAHS and Essex Cnty. Bd. of Social Servs., OAL DKT. NO. HMA 05732-16, 2016 N.J. AGEN LEXIS 645, Initial Decision (July 26, 2016). Even though the agency did not make much of a showing that it had met its responsibility to assist the son of an applicant in completing an application for Global Options Medicaid benefits, the facts did show that the agency had given the applicant's son about 18 months to obtain five years of financial records. That being the case, the agency's action denying the application was properly sustained. D.M. v. Camden Cnty. Bd. of Social Servs. et al, OAL DKT. NO. HMA 04971-16, 2016 N.J. AGEN LEXIS 404, Initial Decision (May 26, 2016). Agency director rejected ALJ's finding that a county social services board had acted properly in determining that an applicant was ineligible for Medicaid. The agency failed to show any reason for the delay in processing the application, did not show that the applicant failed to provide necessary verifications, and failed to show that the applicant had excess resources. N.V. v. DMAHS and Gloucester Cnty. Bd. of Social Servs., OAL DKT. NO. HMA 01201-16, 2016 N.J. AGEN LEXIS 642, Final Administrative Determination (May 5, 2016). Son's failure to obtain and provide, to a county board of social services, true copies of agreements and related documents concerning a trust of which his father, an elderly man who was disabled due to Alzheimers, dementia and Parkinson's disease, was the sole trustee afforded grounds for a denial of Medicaid benefits. This was notwithstanding the fact that the son had demonstrated that the documents were not provided because the son simply could not obtain them from the bank where the trust was established.
